Board of Adjustments

General Functions

The Board of Adjustments is a citizen advisory board appointed by the Town Commission, which is empowered to determine variances from the terms of the Land Development Code.  The Board of Adjustments is an independent, quasi-judicial body.  It is empowered to grant relief from the strict application of the Zoning Regulations by authorizing specific variances from appropriate provisions of the code as will not be contrary to the public interest, in cases where literal enforcement of the code will result in unnecessary hardship for the applicant and meets the criteria for granting a variance (Section 7.06.01).  The Board also hears appeals of administrative decisions where the applicant alleges there is an error in an order, requirement, or policy of town staff.

Meetings

The Board of Adjustments meets quarterly or upon decision of the Chairman.  Please check the Calendar for upcoming meetings.

Board Membership

The Board of Adjustments includes five board members appointed by the Mayor with the approval of the Town Commission to serve a term of three years.  If you are interested in serving on the Board of Adjustments, please contact the Town Clerk for an application.

Qualifications

Each member of the Board of Adjustments shall reside in the Town.
