General Functions
The Board of Adjustments was a citizen advisory board appointed by the Town Commission, which was empowered to determine variances from the terms of the Land Development Code. The Board of Adjustments was an independent, quasi-judicial body made up of members of the community. It was empowered to grant relief from the strict application of the Zoning Regulations by authorizing specific variances from appropriate provisions of the code as was not contrary to the public interest, in cases where literal enforcement of the code resulted in unnecessary hardship for the applicant and met the criteria for granting a variance (Section 7.06.01). The Board also heard appeals of administrative decisions where the applicant alleged there was an error in an order, requirement, or policy of town staff.
Meetings
The Board of Adjustments met quarterly or upon decision of the Chairman.
Board Membership
The Board of Adjustments included five board members appointed by the Mayor with the approval of the Town Commission to serve a term of three years.
Qualifications
Each member of the Board of Adjustments resided in the Town.
